Starscream latest to face regulatory action in the Netherlands

The Dutch gambling regulator, Kansspelautoriteit (KSA), has issued a directive to Starscream, compelling the company to halt all operations within the Netherlands or face substantial penalties reaching up to €840,000 (£718,293/$956,234).

As of April 22, KSA confirmed that Starscream has been unlawfully operating in the region without the necessary licenses, specifically targeting Dutch players despite the legal prohibitions in place.

A thorough investigation carried out by KSA focused on the company’s online gaming platforms, including Rantcasino.com, Sugarcasino.com, and Allstarzcasino.com. It was found that Dutch users were able to register and gamble on these sites, all without the requisite authorization.

To legally offer online gambling services in the Netherlands, operators must secure explicit approval from the KSA, ensuring compliance with local laws aimed at protecting consumers.

Investigation Reveals Regulatory Breaches

The investigation commenced in June when KSA agents accessed the Sugarcasino.com and Rantcasino.com platforms. Agents successfully created accounts, deposited funds, and engaged in gambling activities without encountering any restrictions designed to block Dutch players.

During follow-up investigations in September, agents repeated their access successfully, which demonstrated that Starscream had not implemented adequate technical measures to prevent Dutch consumers from accessing their platforms. However, a subsequent visit in December revealed that access was blocked on both sites, indicating a reaction from Starscream to KSA’s scrutiny.

Upon evaluating Allstarzcasino.com in December, agents again found that they could easily create accounts, deposit money, and gamble without facing any blocking mechanisms. This consistently demonstrated that Starscream was operating illegally.

KSA Maintains Stringent Stance on Illegal Gambling

Despite Starscream’s belated attempts to limit access to two of their websites, KSA deemed their operations still illegal, leading to the decision to impose a substantial penalty. This penalty is set at €280,000 per week, with a maximum cumulative penalty of €840,000. The ruling, dated January 21, has just been released publicly.

According to KSA, “The Netherlands has a regulated gambling market designed to better protect players. We are thus committed to taking rigorous action against illegal operations. Penalty payments are typically effective in swiftly terminating unlawful offers, and providers may face fines for the duration of the illegal gambling activities.”

Increasing Regulatory Actions on Unlicensed Operators

Starscream is not the only unlicensed operator facing regulatory repercussions in the Netherlands. KSA has intensified its enforcement efforts, recently imposing penalties and warnings on several companies infringing upon Dutch gambling laws.

In early April, Techno Offshore received a fine of €1.2 million for operating without the necessary licenses and owns both Nolimitbet.com and Simplecasino.com brands. Additionally, KSA has instituted a weekly penalty order against Gamusoft for its unauthorized operations related to the esports gambling site csgofast.com, which allows wagering on Counter Strike: Global Offensive.

The recent actions come as the Licensed Dutch Online Gambling Providers (VNLOK) has raised alarms regarding the proliferation of illegal gambling in the Netherlands, following KSA’s disclosure that the country’s channelisation rate stood at a precarious 50% in the second half of 2024.

In a related development, VNLOK announced the resignation of Helma Lodders as its chair. Björn Fuchs has been appointed as the new chair and will simultaneously serve in his role as the chief digital officer at Fair Play Casino.
