Ireland ushers new regulator into force as gambling law goes live
On March 5, 2024, the Gambling Regulatory Authority of Ireland (GRAI) officially commenced operations, signifying a pivotal shift in the regulation of gambling within the country. The GRAI’s primary mandate is to enforce and oversee the recently enacted Gambling Regulation Act 2024, focusing on enhancing public safety and ensuring responsible gambling practices.
The GRAI’s extensive jurisdiction encompasses both retail and online gambling sectors. The authority is responsible for the licensing of operators under the new regulatory framework and will also oversee lotteries, with the exception of the national lottery.
Established as a key component of the Gambling Regulation Act 2024, which was passed by the Irish parliament on October 16, 2023, the GRAI is currently in the process of appointing essential personnel, including a chairman and board members, as well as licensing professionals tasked with implementing regulations effectively.
Leadership and Expert Involvement at GRAI
In conjunction with its formal launch, the GRAI has appointed seven expert members to its board. This team is spearheaded by Paul Quinn, the former CEO of the nation’s government procurement office, bringing invaluable administrative experience to the regulatory body.
The board also includes Celine Craig, a former media commissioner, and Rita Purcell, currently serving as the deputy CEO of international and legal affairs at the Health Products Regulatory Authority. Additionally, Dr. Colin O’Driscoll, a senior psychologist and clinical lead for mid-west addiction services in Ireland, has been appointed to ensure a robust approach to public health concerns related to gambling.
Anne Marie Caulfield, who was appointed CEO of the GRAI in 2022, continues to lead the organization, steering its early development and strategic direction.
“Today marks a significant milestone in the evolution of gambling regulation in Ireland,” noted Jim O’Callaghan, Minister for Justice, in a prepared statement. “The new Gambling Act addresses the complexities of responsible gambling in 21st-century Ireland, striking a balance between operator freedoms and the necessary safeguards to protect consumers from addiction.”
Funding the GRAI
During the parliamentary debates leading up to the passage of the Gambling Regulation Act, concerns were raised about the GRAI’s authority and the extent of its impact on the gambling sector. However, Deputy James Browne, the bill’s rapporteur, assured parliament that the GRAI would possess substantial regulatory powers and that its operations would be funded by the gambling industry itself.
“I assure you that the GRAI will be anything but ineffective,” Browne stated. “With an estimated industry worth of €6 billion, it will be a formidable regulatory entity financed through industry levies, ensuring no financial burden on taxpayers once operational.”
Overview of the Gambling Regulation Act 2024
The enactment of the Gambling Regulation Act 2024 introduces a comprehensive suite of measures designed to regulate gambling practices and mitigate the risks of problematic gambling behaviors.
This landmark legislation repeals obsolete gaming laws, consolidating Ireland’s gambling legislation into a unified framework. Key provisions include:
- Banning Credit Payments: Operators are prohibited from accepting credit card payments or other credit facilities.
- ATM Restrictions: The installation of ATM machines at gambling venues is forbidden.
- Inducement Measures: Operators cannot offer inducements such as VIP treatment, free bets, or complimentary services.
- Self-Exclusion Options: A national gambling exclusion register will allow individuals to voluntarily exclude themselves from gambling activities across all operators.
- Advertising Restrictions: Marketing via social media will require adult opt-in, and television and radio advertisements will be prohibited from 5:30 AM to 9 PM to protect children. The sale of children’s clothing adorned with gambling branding is also banned.
